The results showed that among the more than 90 clothing suppliers whose information was collected, 32 had not registered with the local industrial and commercial administrative departments.
By 2011, although Walmart's clothing sales had changed significantly in terms of reducing the number of "black factories", as one of the world's top 500 retail giants, it still sells products produced by unregistered companies in its stores in China. Lawyers believe that this constitutes the sale of "three-no" products and Walmart should bear legal responsibility.
Reporters from the National Business Daily contacted Walmart several times to learn about its views on the unregistered suppliers, but no response was received as of press time.
Suppliers: Wal-Mart rarely comes to inspect factories Compared with the data of 6 unregistered clothing suppliers obtained by the reporter of Daily Economic News this year, the data of Wal-Mart in 2007 was even higher. At that time, among the 89 clothing companies collected by the reporter from Wal-Mart supermarkets in Beijing, Tianjin, Shanghai, Shenzhen, Guiyang and other places, there were 32 companies with no information or relevant data, and about 5 companies did not indicate the company name and address on the clothing tags, so it was impossible to check whether they really existed.
Compared to the past, Walmart has made progress in supplier management. However, for the world's largest retail giant, it is obviously unacceptable that the products it sells come from unregistered companies.
Wang Hui (pseudonym), a Wal-Mart supplier, told the Daily Economic News that when cooperating with supermarkets or department stores, they usually only need to provide a business license, but when cooperating with Wal-Mart, the requirements are very strict. First, suppliers need to provide six certificates, including a business license, an organization code certificate, a general tax payment certificate, a bank account opening permit, a commodity inspection report, and a trademark use certificate, before Wal-Mart will discuss sales with them.
"These certificates are the most basic ones," Wang Hui explained. The product inspection report also includes the company's production and business license and the national standards it is based on. He said that after the two parties have reached an agreement on the terms, the factory inspection will begin. "But generally, few people come to inspect the factory," he said. Walmart also rarely comes to inspect the factory.
The supplier was surprised to find that many of Walmart's suppliers were not registered with the Industrial and Commercial Bureau. "Logically, this shouldn't happen," he said. He said it could be a problem with the supplier or a problem with the supermarket's procurement. "But it's incredible that such a large number of companies are not registered."
The staff of Zhejiang Linhai Tongxin Clothing Co., Ltd. who answered the reporter's phone call said that they had no cooperation with Wal-Mart and that they were just a clothing wholesale company that shipped goods from Beijing to all parts of the country. However, the reporter could not find any information about Tongxin Clothing on the website of the Zhejiang Taizhou Industrial and Commercial Bureau.
There is a clothing brand called "Beverly Hills" in Walmart stores, and the manufacturer shown on the tag is "Beijing Lilin Clothing Co., Ltd.". However, when the reporter called Lilin Clothing, the person who answered the phone said that the "Beverly Hills" clothing the reporter saw in Walmart had nothing to do with them. As for why their phone number was on the tag of the brand's clothing, they didn't know either.
Ms. Liu from Guangdong Puning Jiating Garment Co., Ltd. said that the company is a factory with about 100 employees and produces more than 1,000 pieces of women's clothing every day. She said that the company has no contact with Wal-Mart. When asked by reporters why the company's products are sold in Wal-Mart stores, she said, "It may be that the agent has contact with Wal-Mart."
Several suppliers told the Daily Economic News reporter that the cooperation with Wal-Mart was initiated by the other party. "They provided us with styles and requirements, and guaranteed that all these clothes would be sold in Wal-Mart, so we cooperated with them." Some suppliers said that they were small in scale and did not know how Wal-Mart found them.
Lawyer: Wal-Mart failed to fulfill its duty of review "This shows that the regulatory authorities are not doing a good job of supervision and Wal-Mart is not strict in reviewing suppliers. From another perspective, it just shows that Wal-Mart is exploiting dealers too much. Dealers have to resort to some illegal means to evade relevant taxes and fees in order to make a profit." Shan Zhengguo, a lawyer at Shandong Yuanding Law Firm, said, "It may be that some dealers entered Wal-Mart legally at the beginning, and then took advantage of loopholes in lax supervision to evade taxes and fees, resulting in this situation."
Shan Zhengguo said, "Sellers should establish and implement a system for inspection and acceptance of incoming goods, and verify product certificates and other identifications." The clothing manufacturer sold in Walmart stores was found to be unregistered, which means that Walmart did not fulfill its review responsibilities.
Shan Zhengguo said that commodities circulating in the market must indicate the product name, manufacturer's name and address and other authentic information in Chinese on the packaging. "Business operators should provide consumers with true information about goods or services and shall not make misleading false propaganda." Shan Zhengguo said, "If consumers' legitimate rights and interests are damaged when purchasing or using goods, they can ask the seller for compensation. After the seller pays compensation, if it is the responsibility of the manufacturer or other sellers who provide goods to the seller, the seller has the right to seek compensation from the manufacturer or other sellers."
