Fujian's second child maternity leave is up to 180 days

The first plenary session heard the explanation of Zhu Shufang, director of the Provincial Health and Family Planning Commission, on the "Draft Amendment to the Fujian Provincial Population and Family Planning Regulations", and the preliminary review report of Song Minwang, director of the Education, Science, Culture and Health Working Committee of the Provincial People's Congress Standing Committee, on the "Draft Amendment to the Fujian Provincial Population and Family Planning Regulations".

The meeting discussed in groups the "Decision of the Standing Committee of the Fujian Provincial People's Congress on Amending the Fujian Provincial Population and Family Planning Regulations (Draft)".

The meeting voted and passed the "Decision of the Standing Committee of the Fujian Provincial People's Congress on Amending the Fujian Provincial Population and Family Planning Regulations".

Things related to childbirth have changed. Let’s take a look:

Maternity Leave

For couples who give birth to children in accordance with this regulation, the woman's maternity leave is extended to 158 to 180 days

Before the regulations were amended, if the first child met the criteria for late childbearing (the woman was over 24 years old or the man was over 30 years old) and the woman had received the Honorary Certificate for Parents of an Only Child, her maternity leave was 135 to 180 days.

There are no regulations regarding maternity leave for a second child. People generally refer to Article 62 of the Labor Law: "Female employees are entitled to maternity leave of no less than 98 days when giving birth."

Therefore, there is a general impression that "the maternity leave for the first child is half a year, and the maternity leave for the second child is 98 days." Now after the "universal two-child policy", the first and second children can enjoy the same length of leave. Of course, if your first child is twins or multiples, you cannot have a second child.

When a wife gives birth, the husband is entitled to care leave. The man is entitled to 15 days of care leave, compared to the previous rule of 7 to 10 days. Husbands, you must spend all the extra time with your wife and children.

During maternity leave and care leave, wages will continue to be paid and promotion will not be affected.

Marriage Leave

Couples who have registered their marriage according to law are entitled to 15 days of marriage leave

In the revised family planning regulations, the terms "late marriage" and "late childbearing" disappeared and became history. The 15-day marriage leave that was previously only available to those who married late is now available to everyone.

Three children?

Who is approved to have three children?

1. One of the two children is disabled and cannot grow up to be a normal labor force, but the couple is medically considered to be able to have another child;

2. One of the remarried couples already has two children before the remarriage and the other has no children, or both parties have one child before the remarriage;

3. One of the remarried couples had no children before the remarriage, while the other had one child, and they both gave birth to one child after the marriage;

4. Both spouses are ethnic minority rural residents who are only children; (If one spouse is Han and the other is an ethnic minority, and the Han spouse settles in the ethnic minority township or village and has lived there for more than five years, and the child born is designated as an ethnic minority according to relevant regulations, this clause applies)

5. Other circumstances stipulated by laws, regulations and the state.

If a person wishes to have another child in accordance with the requirements of these Regulations, the health and family planning administrative department of the county (city, district) people's government shall approve the application within 15 working days and issue a birth service certificate.

The above provisions can be understood as follows:

● If the couple has two children before remarriage, they can have another child after remarriage.

● Before remarriage, the couple had only one child together, and after remarriage they can have two more children

There is another situation that needs special mention, which is "adoption". Adopting a child does not affect having one's own children, and you can even have two.

A couple who legally adopts a child can have two children.

Cross-border marriage

What are the rules for having children when marrying overseas Chinese, residents of Hong Kong, Macao and Taiwan, or foreigners?

If both spouses are returned overseas Chinese and their children born before returning to settle in China are settled abroad, they shall not be counted in the number of children born as referred to in these Regulations and may be given birth in accordance with the provisions of these Regulations.

The provisions of the preceding paragraph shall apply to spouses of overseas Chinese who have settled in our province.

Hong Kong, Macao, Taiwan, foreign countries

If one spouse is a resident of this province and the other spouse is a resident of the Hong Kong Special Administrative Region, the Macao Special Administrative Region or the Taiwan region, the provisions of these Regulations shall apply. However, children born to the spouses after their marriage and children already existing before marriage of the spouse who is a permanent resident of the Hong Kong Special Administrative Region, the Macao Special Administrative Region or the Taiwan region and who do not reside in the territory shall not be counted in the number of children born as referred to in these Regulations and may be born in accordance with the provisions of these Regulations.

If one spouse is a resident of this province and the other is a foreign citizen, the provisions of the preceding paragraph shall apply.

This passage may seem a bit complicated. To put it simply, it depends on whether the children have a domestic ID card. If they do not have a domestic ID card, they will not take up the quota for “number of children born”.

Certificate of Honor for Parents of Only Child

This red book may become less and less common in the future.

According to the revised regulations, the application conditions are that during the period when the country advocates that a couple have only one child, couples who voluntarily choose to have only one child for life can apply for the Honorary Certificate for Parents of an Only Child from the township (town) people's government or street office before their child reaches the age of fourteen, receive a one-time reward of no less than one thousand yuan, and enjoy related preferential treatment and rewards.

After the “universal two-child policy”, even if you only have one child, you will no longer have this certificate of honor or reward money; for those who received a certificate of honor in the “one-child era” and now plan to have a second child, the certificate will not be taken back, but you will stop enjoying the relevant preferential treatment and rewards from the date of registration for birth services.

During the period when the country advocates that a couple have one child, rural families and couples who have received the Honor Certificate for Parents of an Only Child or who have given birth to two girls and have been sterilized can enjoy basically the same rewards and preferential policies as before.
