According to the Notice of the State Administration for Industry and Commerce and other five departments on the implementation of the Notice of the General Office of the State Council on accelerating the reform of the "Five-in-One" registration system (hereinafter referred to as the "Notice"), all relevant departments must ensure that the "Five-in-One" reform is implemented nationwide from October 1, 2016. The following questions are of concern to everyone, so that everyone can have a more specific understanding of the "Five-in-One".

Q: What is the relationship between "three certificates in one" and "five certificates in one"?

Answer: On the basis of the "three certificates in one, one license and one code" for enterprises and farmers' professional cooperatives (hereinafter referred to as "enterprises"), the "five certificates in one, one license and one code" registration model will be fully implemented, integrating the social insurance registration certificate and the statistical registration certificate. The business license with the unified social credit code (hereinafter referred to as the unified code) of legal persons and other organizations will be issued by the industrial and commercial administrative department. Social insurance registration certificates and statistical registration certificates will no longer be issued separately.

Q: After the "Five Certificates in One" reform, if an enterprise needs to apply for establishment registration or apply for a replacement business license, what should it do?

Answer: The registration conditions, registration procedures, registration application document specifications and business license styles for the “five-in-one” policy are the same as those for the “three-in-one” reform.

After the reform, if an enterprise applies for establishment registration, the original license expires, or applies for change registration or renewal of business license, the registration authority shall issue or renew the business license with a unified code in accordance with the law. The renewal of business licenses and the method of assigning unified codes, as well as the collection and management of the original certificates and licenses of enterprises, shall continue to be carried out in accordance with the requirements of the Notice.

For enterprises that have obtained social insurance registration certificates and statistical registration certificates, the original social insurance registration certificates and statistical registration certificates will no longer be collected.

Q: If you have already obtained a "three-in-one" business license, do you need to reapply for "five-in-one" registration?

A: No. Enterprises that have obtained a business license with a unified social credit code in accordance with the "three-in-one" registration model do not need to reapply for the "five-in-one" registration. The registration authority will send the relevant registration information to social insurance agencies, statistical agencies and other units.

Q: Do enterprises that have obtained a business license with a unified code need to provide a social insurance registration certificate or a statistics registration certificate when handling related matters?

A: No. All relevant departments should recognize, use and promote the "one license, one code" business license in their respective fields. When enterprises that have obtained a business license with a unified code handle related matters, they will no longer be required to provide social insurance registration certificates and statistical registration certificates. For enterprises that hold the original certificates and licenses for filing and approval, they will not be required to go through the change procedures again due to the replacement of business licenses with unified codes, which will effectively reduce the burden on enterprises.

Q: How to make the transition to the "Five Certificates in One" reform?

Answer: Before January 1, 2018, the original licenses will continue to be valid. After the transition period, all business licenses with unified codes will be used, and the unrenewed licenses will no longer be valid. The regular verification and renewal system for social insurance registration certificates and statistical registration certificates will be cancelled. The matters that enterprises were required to submit for verification and renewal will be integrated into the annual report of the enterprise. The enterprise shall submit the annual report to the industrial and commercial department and make it public.

Q: How to achieve information sharing?

Answer: Establish a normalized information sharing mechanism between the provincial credit information sharing platform and the national credit information sharing platform, push the basic registration information and related credit information of enterprises to the national credit information sharing platform, and realize information sharing across the country.

The enterprise registration authorities, human resources and social security departments, and statistical departments of provinces (autonomous regions, municipalities directly under the central government) that are currently unable to achieve real-time transmission of registration information should further strengthen cooperation, jointly promote the construction of provincial credit information sharing platforms, and achieve real-time transmission of registration information as soon as possible.

Answer: Realizing “five certificates in one, one license and one code” is an important measure to continue to deepen the reform of the commercial system, optimize the business environment, and promote mass entrepreneurship and innovation. It is of great significance to create a market environment conducive to entrepreneurship and innovation, stimulate market vitality and social creativity, promote entrepreneurship and innovation and economic development, promote information sharing among departments, and enhance government management and service capabilities.

Scope of application

From October 1, 2016, enterprises and farmers' professional cooperatives registered with the industrial and commercial departments shall manage their social insurance registration certificates in accordance with the "five certificates in one, one license and one code" registration system.

State organs, public institutions, social groups and other units that are not included in the "five certificates in one, one license and one code" registration system management shall still go to the social insurance agency to handle social insurance registration in accordance with the original method. The social insurance agency shall issue a social insurance registration certificate and gradually adopt a unified social credit code to manage the registration certificate.

Simplified process

When a newly established enterprise goes through the industrial and commercial registration process, it also completes the social insurance registration. Before the implementation of the "five certificates in one" system reform, enterprises were required to provide indicators such as bank account numbers when registering for social insurance for their employees. After the reform, enterprises are required to provide these indicators when registering for social insurance for their employees.

After an enterprise completes the "five-in-one" registration, the social insurance agency should promptly receive the data exchanged by the industrial and commercial department, generate the enterprise's "Social Insurance Registration Form", and archive it in accordance with regulations. After the enterprise registration information is changed or cancelled, the social insurance agency should promptly update the enterprise's social insurance registration information based on the exchanged data from the industrial and commercial department. Among them, enterprises that have participated in social insurance still need to go to the social insurance agency to cancel their registration after completing the industrial and commercial cancellation registration.

How to connect

After receiving the enterprise social insurance registration information shared by the industrial and commercial departments, the social insurance agency shall remind and urge the enterprises that have obtained the "five-in-one" business license to go to the social insurance agency in a timely manner to complete the insurance registration procedures for employees within 30 days after the employment occurs through public letters, announcements, text messages, etc. If the employee insurance registration procedures are still not completed after the deadline, the agency shall request the relevant departments to require the employer to fulfill the employee insurance payment obligations in accordance with the law.

When an enterprise handles insurance registration procedures for its employees, the social insurance agency should check the "five-in-one" business license. For enterprises that have obtained data information from the industrial and commercial department, the social insurance agency can directly retrieve the basic information of the unit, supplement the bank account number and other relevant information, and complete the employee insurance registration. If the relevant information supplemented during the employee insurance registration changes, the enterprise shall go through the change procedures with the social insurance agency.

Falsely declare social security participation and payment

Will be punished

After simplifying the application process for enterprise social insurance registration certificates and canceling the periodic verification and renewal of social insurance registration certificates, social insurance agencies should continue to do a good job in reporting and verifying the annual payment base. During the periodic verification of the original social insurance registration certificate, the number of people participating in social insurance, the total amount of paid wages, the amount of paid wages, the unpaid social insurance premiums, etc., which were required to be reported by the enterprise, should be included in the annual report of the enterprise, and the enterprise should report to the industrial and commercial department and make it public.

For enterprises that have obtained the "five-in-one" business license and have generated employment, they should verify whether they have fulfilled their insurance and payment obligations in accordance with the law by checking insurance and payment certificates and social insurance personal rights and interests records. For those who have made false public announcements or reported social insurance participation and payment, they should be urged to correct them; if the circumstances are serious, they should consult with relevant departments to carry out joint punishment.
