Article 42 of the Labor Contract Law stipulates that an employer may not terminate the labor contract of a female employee during her pregnancy, delivery or breastfeeding period.

Article 27 of the Law on the Protection of Women's Rights and Interests also states: "No unit may reduce the wages of female employees, dismiss female employees, or unilaterally terminate labor (employment) contracts or service agreements due to marriage, pregnancy, maternity leave, breastfeeding, etc."

On the other hand, various social insurances, including maternity insurance, are compulsory insurance and must be handled by employers. Article 46 of the Labor Contract Law clearly stipulates that a labor contract that violates the mandatory provisions of factory inspection laws and administrative regulations is invalid.

The Notice of the Ministry of Labor on Several Issues Concerning the Treatment of Female Employees for Childbirth provides a more detailed explanation of the relevant issues: When a miscarriage occurs within four months of pregnancy, a maternity leave of fifteen to thirty days shall be granted based on the opinion of the medical department; when a miscarriage occurs after four months of pregnancy, a maternity leave of forty-two days shall be granted. If a woman is still unable to work due to physical reasons after the expiration of the maternity leave, the treatment during the period exceeding the maternity leave shall be handled in accordance with the relevant provisions on sick employees after certification by the medical department.
