IBM Factory Audit Consulting Supplier Code of Conduct IBM Supplier Code of Conduct At IBM, we hold ourselves to high standards for the way we do business – ranging from corporate responsibility, social responsibility and good business ethics, including compliance with all applicable laws and regulations. In turn, we expect our suppliers to follow the same commitment. That's why we developed the IBM Supplier Code of Conduct. These codes address our commitment to our clients, our legacy of innovation and relationships built on integrity and personal responsibility. They set out the conduct required to do business with IBM. Our goal is to work with our suppliers to ensure full compliance with these principles as they apply in turn to suppliers that provide products and services to IBM. We will consider these principles when selecting suppliers and will proactively monitor their compliance. Forced or involuntary labor IBM suppliers shall not employ any type of forced or involuntary labor (for example, forced, bonded, indentured, or involuntary prison labor); employment relationships shall be voluntary. child labor IBM suppliers may not employ child labor. The term "child labor" refers to employees who are under the age of 15 (or 14 as required by law in some countries), under the age for completing compulsory education, or under the minimum age for employment in the country, whichever is greater. We support the use of legitimate workplace apprenticeship programs that comply with all laws and regulations applicable to such apprenticeship programs. Compensation and Benefits At a minimum, IBM Suppliers shall comply with all applicable wage and hour laws and regulations (including those relating to minimum wage, overtime pay, piece rates and other components of compensation) and provide legally required benefits. Working hours IBM suppliers shall not exceed normal local working hours and shall provide appropriate compensation for overtime. Workers shall not be required to work more than 60 hours per week (including overtime) except in special business circumstances with their consent. In countries or regions with smaller work week maximums, this standard shall apply. Employees shall be allowed at least one day off in a seven-day week. Anti-discrimination IBM suppliers must not discriminate in recruiting and hiring based on race, religion, age, nationality, social or ethnic background, sexual orientation, gender, gender orientation or expression, marital status, pregnancy, political affiliation or disability. IBM suppliers must treat all employees with respect and not use corporal punishment, threats of violence or other forms of physical coercion or victimization. Freedom of assembly IBM suppliers shall respect the legal rights of their employees to choose or refuse to join worker organizations, including unions. Suppliers have the right to establish favorable employment conditions and maintain effective employee communication programs as a means of promoting positive employee relations. Health and Safety IBM suppliers are required to provide their employees with a safe and healthy workplace that complies with all applicable laws and regulations. To meet these obligations, IBM suppliers must develop and implement effective programs around: personal safety, accident investigation, chemical safety, ergonomics, etc., and provide the same health and safety standards for all housing provided to employees. Suppliers must strive to establish management systems to meet these requirements. Environmental Protection IBM suppliers are required to operate in a manner that protects the environment. At a minimum, suppliers must comply with all applicable environmental laws, regulations and standards, such as requirements regarding chemical and waste management and disposal, recycling, industrial wastewater treatment and discharge, air emission control, environmental permits and environmental reporting. Suppliers must also comply with any additional environmental requirements specific to products or services provided to IBM, as specified in design and product specifications and contract documents. Suppliers shall strive to establish management systems that meet these requirements. Laws and Regulations IBM suppliers are required to comply with all applicable laws and regulations wherever they do business. Ethical Conduct IBM expects our suppliers to conduct their business in accordance with the highest ethical standards. Suppliers must strictly comply with all laws and regulations regarding bribery, corruption and prohibited business practices. Communications Suppliers must communicate the IBM Supplier Code of Conduct and other related information to employees and supervisors in their native language. Monitoring/Record-keeping Suppliers must maintain documentation necessary to document IBM's implementation of the IBM Supplier Code of Conduct and must provide IBM with access to such documentation upon IBM's request. |
