BSCI factory audit standards

1. BSCI in Part B5 is about underage workers and child labor. Underage workers are particularly important in the BSCI standard. In the LIDL standard of BSCI's core member, underage workers' violations require factories to make improvements within two weeks and follow up audits in a timely manner. They are at the same risk level as child labor. The relevant standards for underage workers include: some provinces and cities have regulations that underage workers are not allowed to work overtime, regulations on the registration of underage workers, requirements for physical examinations for underage workers, and underage workers cannot work in toxic and harmful positions, night shifts, or heavy physical labor. And opportunities for underage workers to continue their studies and education.

Second, BSCI's regulations on fines Many factories that applied for BSCI certification have failed to pass the audit due to fines. Most social responsibility audit standards clearly stipulate that workers cannot be fined instead of education. The factory's dilemma is that without the management tool of fines, many disciplinary measures in production management may not be implemented in place. For example, if employees insist on not obeying management and harassing other employees, it is unlikely to be effective to persuade and educate them. Chinese law stipulates that employees can be fined as long as it does not exceed 20% of the monthly salary. Of course, the final salary must be higher than the minimum wage standard.

3. Wage requirements Wages and benefits are the top priority of BSCI audits. Any slight violation may result in a total loss and a score of 0 in the end. This is not an exaggeration.
Minimum wage standard:
The minimum wage standard is the wage standard issued by the local labor and social security department. It is the minimum wage that employees receive for working during normal working hours, excluding overtime pay, social security fees, etc.
Overtime pay:
Overtime pay is 150% on weekdays, 200% on weekends, and 300% on holidays. What if holidays overlap with weekends? You must pay attention to this situation.
Holiday pay:
Legal holidays should be treated as if employees were working and should be paid the corresponding wages, but this rule is often violated by factories.
Wages for work stoppage:
Since the factory employees caused the employees to take a break, they should be paid back wages.
Paid annual leave salary:
It shall be paid in accordance with national regulations. If employees do not enjoy paid annual leave, they shall be paid according to the standards for holiday overtime pay.
Resignation salary payment:
When an employee resigns, the time limit for salary payment.
There are different calculation methods for time-based wages and piece-rate wages.

IV. Requirements for working hours
BSCI was initiated and founded by the European Foreign Trade Agency FTA, but the standard used is the SA8000 standard written by Americans. Therefore, when BSCI cited the SA8000 standard, it changed the importance of some requirements. As we all know, European trade unions are very powerful and often initiate strikes; while the number of American trade unions has decreased by 30% in the past 20 years, and the number and number of strikes has decreased by 60%. The United States has even enacted laws stipulating that temporary workers and hourly workers cannot join trade unions. The reason why the similarities and differences between BSCI and SA8000 standards are introduced before introducing the BSCI working hour standard is that after the BSCI organization introduced the SA8000 standard into Europe, it made changes according to the standards of European trade unions, including working hours. Compared with the working hours stipulated by Chinese laws, BSCI pays more attention to the control of weekly working hours, because this is the consistent standard in Europe and the standard that is more accepted by trade unions in European countries. If there is a violation of weekly working hours in BSCI, it will be directly given 0 points, so you must not be careless about working hours. Simply put, you can violate Chinese laws, but you cannot violate the unified standards of European trade unions. The changes made by the BSCI organization in terms of standards are not only reflected in working hours, but also in terms of trade unions and employee associations, which are in line with the standards of European trade union organizations.
